These Terms & Conditions ("Terms") govern your use of foundorgone.com and the services offered by Found or Gone ("we," "us," or "our"). By using our website, submitting a quote request, or engaging our services, you agree to these Terms.
1. Our Services
Found or Gone provides website design, build, and hosting services for businesses. Specific deliverables, pricing, and timelines for any project are agreed separately in writing (by proposal, invoice, or agreement) before work begins.
2. Quotes and Payment
Quote requests through our website are free and carry no obligation.
Prices quoted are valid for 30 days unless stated otherwise.
Payment terms are set out in your proposal or invoice.
Work begins after any agreed deposit is received.
Cancellation and refund terms for a project are set out in your proposal or agreement.
Ongoing services such as hosting can be cancelled with 30 days' notice unless your agreement says otherwise.
3. SMS/Text Messaging Terms
Found or Gone (foundorgone.com) is a website design service for local businesses.
We send one-to-one, informational text messages to business prospects and clients who have agreed to receive them.
You opt in to receive text messages from us in one of two ways: (1) verbally during a phone call with us, by agreeing to receive your website preview link by text, or (2) by checking the required consent box on the quote request form at foundorgone.com.
You may also text us first, in which case we will reply.
Messages we send include a link to your website preview as discussed on our call, replies to your quote request or questions, project updates, and appointment reminders.
We do not send bulk marketing text campaigns.
Examples of the messages we send:
"Hi [Name], it's [Your Name] from Found or Gone. As discussed on our call, here is a preview of your website: [link] Reply STOP to opt out, HELP for help."
"Hi [Name], it's [Your Name] from Found or Gone. Thanks for your quote request at foundorgone.com. When suits a quick call to talk through your new website? Reply STOP to opt out."
"Hi [Name], [Your Name] from Found or Gone here. Just checking you got your website preview link. Happy to walk you through it whenever suits. Reply STOP to opt out."
Message frequency varies and is typically low.
Message and data rates may apply.

Opt out at any time by replying STOP to any message.
After you reply STOP, we will send one final message confirming your opt-out, and you will receive no further messages unless you opt back in.

You can use our services without agreeing to receive text messages.
You must be 18 or older and the account holder (or have the account holder's permission) for the mobile number provided.
Wireless carriers are not liable for delayed or undelivered messages.

4. Website Use
You agree not to misuse our website, attempt to gain unauthorized access to it, or use it for any unlawful purpose. Content on this site (text, design, graphics) belongs to Found or Gone and may not be copied without permission.
5. Client Content and Ownership
For website projects: you retain ownership of the content, branding, and domain name you provide or that we register on your behalf. Upon full payment, you own your completed website as set out in your project agreement.

Our website and its content are provided "as is." While we work to keep information accurate and the site available, we do not guarantee the site will be uninterrupted or error-free. We do not guarantee specific business results (such as search rankings, traffic, or revenue) from any website we build.
7. Limitation of Liability
To the fullest extent permitted by law, Found or Gone is not liable for indirect, incidental, or consequential damages arising from your use of this website. Our total liability for any claim related to our services is limited to the amount you paid us for those services.
8. Third-Party Links and Services
Our website or your project may involve third-party services (hosting platforms, payment processors, phone/SMS providers). We are not responsible for the content or practices of third-party services, which are governed by their own terms.
